Welcome to Creation Atelier. The terms “we,” “us,” and “our” refer to Creation Atelier. We operate this website and store and provide the related information, content, products, tools, and services (the “Services”). Our store is powered by Shopify.

By visiting our website, placing an order, or otherwise using the Services, you agree to these Terms of Service and our Privacy Policy. If you do not agree, please do not use the Services.

1. ELIGIBILITY AND ACCOUNTS

You must be at least the age of majority in your place of residence, or use the Services with the consent of a parent or legal guardian. You agree to provide accurate, current, and complete information when using the Services or placing an order. You are responsible for keeping your account credentials secure and for activity under your account.

2. PRODUCTS AND PERSONALIZATION

Creation Atelier offers handmade and personalized art products. Product images, colors, textures, finishes, and dimensions may vary slightly because of screen settings, photography, natural materials, and the handmade process. These variations are not defects. You are responsible for reviewing all personalization details, including names, dates, spelling, and other submitted information, before placing your order.

We may modify or discontinue products, limit quantities, or refuse service where permitted by law. Product descriptions and availability may change without notice.

3. ORDERS

Submitting an order is an offer to purchase. An order is accepted only after we confirm it and receive payment. We may accept, decline, or cancel an order for reasons including product availability, suspected fraud, pricing or listing errors, or inability to complete the requested personalization. If we cancel a paid order, we will issue the applicable refund.

Because personalized products may enter production soon after purchase, changes or cancellations may not be possible after an order is accepted. Please contact us promptly at support@theoriginalcreation.com if you need assistance.

4. PRICES, TAXES, AND PAYMENT

Prices are shown in the currency displayed at checkout and may change without notice. Unless stated otherwise, prices do not include shipping, taxes, customs duties, import fees, or similar charges. You agree to provide valid and accurate billing and payment information and authorize us and our payment providers to charge the amounts shown at checkout.

5. SHIPPING AND DELIVERY

Shipping and delivery dates are estimates and are not guaranteed. We are not responsible for delays caused by carriers, customs, incorrect or incomplete addresses, weather, or events outside our reasonable control. Customers are responsible for customs duties, import taxes, and fees unless checkout expressly states otherwise. Please review our Shipping Policy for additional details.

6. RETURNS, REFUNDS, AND CANCELLATIONS

Returns, refunds, replacements, and cancellations are governed by our Refund Policy. Personalized or made-to-order items may be ineligible for return except where required by law or where an item arrives damaged, defective, or materially different from the order.

7. INTELLECTUAL PROPERTY

The Services and their content—including text, photographs, artwork, graphics, logos, product designs, and site design—are owned by or licensed to Creation Atelier and protected by applicable intellectual property laws. You may use the Services only for personal, non-commercial purposes. You may not copy, reproduce, distribute, modify, sell, exploit, or create derivative works from our content without prior written permission.

8. ACCEPTABLE USE

You may not use the Services for unlawful, fraudulent, abusive, harmful, or infringing purposes; transmit malicious code; interfere with the operation or security of the Services; collect other users’ information without authorization; impersonate another person; or use automated tools to scrape, copy, or overload the Services. We may suspend or terminate access for violations of these Terms.

9. THIRD-PARTY SERVICES AND LINKS

The Services may include links to or features provided by third parties. We do not control and are not responsible for third-party websites, products, policies, or practices. Your use of third-party services is subject to their own terms and policies.

10. SHOPIFY

Our store is powered by Shopify, which enables us to provide the Services. Purchases are made directly from Creation Atelier, not Shopify. To the extent permitted by law, Shopify is not responsible for the products, transactions, injuries, losses, or damages arising from purchases made from Creation Atelier.

11. PRIVACY

Personal information collected through the Services is handled according to our Privacy Policy. Shopify and other service providers may process information as necessary to operate the store, checkout, payments, fulfillment, analytics, fraud prevention, and customer support.

12. DISCLAIMER OF WARRANTIES

To the fullest extent permitted by law, the Services and products are provided “as is” and “as available,” except for warranties that cannot legally be excluded. We do not guarantee that the Services will be uninterrupted, error-free, or completely secure. Nothing in these Terms limits any mandatory consumer rights that apply to you.

13. LIMITATION OF LIABILITY

To the fullest extent permitted by law, Creation Atelier and its owners, employees, affiliates, agents, contractors, and service providers will not be liable for indirect, incidental, special, punitive, or consequential damages, including lost profits, revenue, savings, data, or replacement costs, arising from use of the Services or products. Where liability cannot be excluded, our total liability will not exceed the amount you paid for the product or order giving rise to the claim.

14. INDEMNIFICATION

You agree to indemnify and hold Creation Atelier and its affiliates, employees, agents, contractors, licensors, and service providers harmless from third-party claims, losses, and reasonable expenses arising from your unlawful use of the Services, your breach of these Terms, or your violation of another person’s rights, to the extent permitted by law.

15. TERMINATION

We may suspend or terminate your access to the Services if you violate these Terms or applicable law. Provisions that by their nature should survive termination—including intellectual property, disclaimers, limitations of liability, indemnification, and governing law—will remain in effect.

16. SEVERABILITY AND WAIVER

If any provision of these Terms is held unenforceable, the remaining provisions will continue in effect. Our failure to enforce a provision is not a waiver of that provision or any other right.

17. GOVERNING LAW

These Terms and any separate agreements for the Services are governed by the laws of the State of Colorado, United States, without regard to conflict-of-law principles. You and Creation Atelier consent to the jurisdiction of the applicable state and federal courts located in Colorado, except where mandatory consumer law provides otherwise.

18. CHANGES TO THESE TERMS

We may update these Terms by posting a revised version on this page. The “Last updated” date will identify the current version. Material changes will take effect as required by applicable law. Continued use of the Services after an update constitutes acceptance of the revised Terms.
